The biggest takeaway from the Fifth Circuit ruling is that employers and supervisors should stay on top of time records and quickly address incomplete or inaccurate information, [Bickford] said.
“The Five Star case … basically reminds us that we can’t put our head in a bushel and pretend we don’t see things,” Bickford said. “We have a duty to go look to verify attendance and to make sure it’s being properly compensated.”
