Member Kelly Lipinski (Cleveland) will present “CFPB Oversight: Examinations, Areas of Focus, and What Should Keep You Up at Night” on June 14, 2023, at the 2023 Student Loan Servicing Alliance (SLSA) Annual Meeting in Denver, Colorado.

Kelly advises clients throughout the United States on regulatory compliance matters involving the consumer financial industry. She counsels a full range of financial institutions, including depository institutions and their affiliates, mortgage companies, sales finance companies, and lenders partnering with fintech companies, with a special focus on serving entities in the private education and motor vehicle finance lending industries.

The SLSA is a nonprofit trade association that focuses exclusively on student loan servicing issues. Members are responsible for servicing over 95% of all federal student loans and the vast majority of private loans and include a mix of companies, state agencies, non-profits, and their service partners. CFPB: Ignorance is No Excuse in FDCPA False, Deceptive, Misleading Violations

On January 2, 2024, the Consumer Financial Protection Bureau (CFPB) filed an amicus brief in the case of Carrasquillo v. CICA Collection Agency, Inc. where it argued that knowledge (i.e. “scienter”) of a violation of the Fair Debt Collection Practices Act (FDCPA) was not required to be found liable for making a false, deceptive, or misleading representation in connection with the collection of a debt.
