Karma Koala Podcast with McGlinchey’s Chase Stoecker

On January 20, 2024, Member Chase Stoecker (Fort Lauderdale) joined Sean Hocking, editor at the Cannabis Law Report, for an episode of the “Karma Koala” podcast, a weekly podcast about all things law, business, and culture in cannabis, to discuss the legal complexities of cannabis in the workplace. Chase explored the confusion faced by employers and employees alike, given the varying state laws regarding off-site cannabis use. The spectrum of state laws, with some offering strong employee protections and others providing minimal safeguards, as well as litigation surrounding medical marijuana in the workplace, ‘safety-sensitive’ laws exempting certain positions from protections, and the requirement for cannabis businesses to adhere to federal employment laws despite cannabis’s illegal federal status, were some of the pressing topics discussed.

The use of medical marijuana, which has been permitted for decades in some states, is not protected under the Americans with Disabilities Act.  As a result, even in states which legally permit its use, employers are free to terminate employees who use medical marijuana without fear of violating federal discrimination laws.
