McGlinchey Attorneys to Participate in 2025 ABA Consumer Financial Services Committee Meeting
Read Time: 2 minsAttorneys from McGlinchey’s Financial Services Compliance and Financial Services Litigation Groups will participate in the American Bar Association (ABA) Business Law Section (BLS) 2025 Consumer Financial Services Committee Meeting in Denver, Colorado, January 24 through January 25, 2025.
On Friday, January 24, Aaron Kouhoupt (Cleveland) and Adam Maarec (Washington, DC) will co-moderate “The CFPB’s Final Rules on Personal Financial Data Rights: The Path to Compliance Amid Regulatory Uncertainty.” This roundtable will provide an overview of the CFPB’s final rules under Section 1033 of the Dodd-Frank Act. Their discussion will examine the substance of the rules’ requirements for data providers and third parties receiving data, practical challenges with implementation, the role of the Financial Data Exchange as the first Recognized Standard Setter, and the banking industry lawsuit trying to block the rule from going into effect.
Aaron also served as Chair of a CLE Program on “Fair Lending Enforcement, Hot Topics, and Predictions.”
On Saturday, January 25, Alexander Green (Washington, DC) will participate in a CLE panel on “Navigating the Latest Developments in FCRA Litigation: Trends, Challenges and Best Practices.” The program will cover:
- The evolution of furnisher liability theories related to legal disputes following decisions in Gross, Milgram, Mader, and Sessa cases and the potential scope of distinctions to be drawn with respect to legal disputes in future appellate decisions.
- The rise of “inquiry” litigation in recent years and the development of jurisprudence in this area.
- The increasing prevalence of manufactured credit denial letters, fact patterns involving manufactured liability following debt settlements, and other tactics that have been observed in efforts to fabricate lawsuits and to extract quick settlements.
