Patrick T. Voke of Boston said the case highlights the level of discretion a judge has in matters.
“In this particular case, the judge could have dismissed the claims in their entirety and likely would have been within her rights to do so,” he said, adding that it was also noteworthy that Lenovo did not have to prove there were documents that were actually destroyed or not produced; it only had to show it could not make such a determination.
