Members Kelly Lipinski (Cleveland) and David Tallman (Houston) will co-present “State Law Developments: Servicing, AI, Privacy, Interest Rate” at the National Council of Higher Education Resources (NCHER)’s Fall Legal Meeting in Chicago, Illinois, on October 24, 2024.

NCHER is the nation’s oldest and largest trade association representing higher education service agencies that help students and families develop, pay for, and achieve their career, training, and postsecondary educational goals. Members include student loan servicers, guaranty agencies, lenders, secondary markets, private collection agencies, schools, and others that administer federal, state, and private loan and grant programs. Many members, including state agencies and state-designated authorities, also provide higher education awareness, access, outreach, loan default prevention, and financial literacy services.

Nevada Adopts Student Loan Servicer and Private Education Lender Regulations

December 10, 2024

At the beginning of 2024, Nevada began to require companies that service student loans to obtain a license and comply with numerous operational requirements. The law also regulates companies that make or hold private education loans.[1] After numerous rounds of proposed rulemaking, the Nevada Department of Financial Institutions (DFI) issued implementing regulations on November 15, 2024, that address the process to obtain and maintain a servicer license, seek approval to operate as a federal student loan servicer, create a new limited purpose exemption to the lender license, and establish new substantive regulations that apply to servicers and lenders.

Illinois SB 86 Brings New Requirements for Student Loan Lenders and Servicers

August 28, 2024

On August 2, 2024, the Illinois governor signed SB 86 into law to amend the Illinois Know Before You Owe Private Education Loan Act and the Illinois Student Loan Servicing Rights Act. Establishing new requirements that will impact student loan lenders and student loan servicers operating in Illinois, SB 86 became effective immediately upon becoming law on August 2, 2024.
