Real estate developers can breathe easier: Senate’s Inflation Act does not strangle “promotes”

Yesterday, the United States Senate passed the Inflation Reduction Act of 2022. As introduced, the Act included a provision requiring that carried interests (known to real estate developers as “promotes”) would have required that developers hold on to their interest in the development venture for 5 years, rather than the current 3 years required by Section 1061 of the Internal Revenue Code (the Code).
