The burden of student loan debt is acute on many borrowers, particularly minority graduates. Kelly Lipinski (Cleveland) will participate in a panel discussion on developing changes in the forgiveness of student loan debt during the ABA Business Law Section Virtual Spring Meeting on April 21, 2021, in conjunction with the Conference on Consumer Finance Law. The panel will address actions to accomplish debt forgiveness and responses to delinquencies during the COVID-19 pandemic, focusing on potential legislation or executive action to forgive existing debt.

While student loan debt forgiveness may be excludible from income for federal income tax purposes, some states do not exclude such debt forgiveness from income for state income tax purposes. This means the borrower may have to pay state income tax on the forgiven student loan debt.

Massachusetts Enacts Student Loan Servicer License Requirement

On January 14, 2021, the governor of Massachusetts signed H 5250 into law, which includes a licensing requirement applicable to student loan servicers, and other requirements related to the regulation and supervision of student loan servicers in Massachusetts. The law will become effective on July 1, 2021, but entities subject to licensure should prepare for the forthcoming licensing requirement soon to ensure a compliance with this new law.
